The "Violet® App" means the mobile software application provided by Ultra, Inc ("Ultra") related to the features of helping you achieve balanced sun exposure, promoting healthy sun experience, and any upgrades from time to time and any other ancillary software that enables the use of the Violet® App.
In order to use the Application, you are required to have a compatible mobile phone or handheld device, internet access, and the necessary minimum specifications ('Software Requirements').

Violet® App is intended to encourage behavioral change toward better health, by reducing the risks while harnessing the benefit of sun. The goal is to motivate user to get outdoors and safely enjoy the sun without the fear, and to live healthier lifestyle.
All information provided by Violet® App is for general recreational purpose only, and Ultra does not accept any responsibility for its accuracy. You acknowledge and agree that the available functions, features and addable applications for application may vary from country to country due to different local laws and regulations. You should check the features and applications available in your specific region before use.
Violet® App and any information and/or services are not intended for use in the detection, diagnosis, monitoring management or treatment of any medical condition, disease or vital physiological processes or for the transmission of time-sensitive health information. Any health- related information found herein and in any materials or information acquired and/or accessed through Violet® App is available only for your convenience and should not be treated as medical advice. Violet® App allows you to access certain links that is also available on www.liveultrahealthy.com ('the Website'), such access will be governed by the Terms of Use of the said website.
All trademarks, copyright, database rights and other intellectual property rights of any nature, as are applicable, in the Violet® App are owned either directly by Ultra or its authorized licensors. You are hereby allowed to use the Violet® App for your personal use only and in accordance with the Mobile app terms including the terms of Website. You will not, nor allow third parties on your behalf to (i) make and distribute copies of the Violet® App (ii) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate the Violet® App; or (iii) create derivative works of the Violet® App of any kind whatsoever. As per your applicable mobile network plan you may be charged by the network Provider for access to internet connection services for the duration of the connection while accessing the Violet® App or any such third party charges as may arise. Ultra will neither be liable nor be responsibility for any such direct or indirect charges that arise.
The contents on the Violet® App are only informative and Ultra does not guarantee the authenticity or accuracy of such contents. No action including commission/omission should be taken based solely on the contents on the Violet® App; you should consult appropriate professionals on any matter relating to the information. Ultra expressly disclaims responsibility and liability for any adverse effects, loss or risk incurred, as a direct or indirect consequence of the use of contents on the Violet® App.
Ultra will take due care to make the Violet® App available at all times. However you acknowledge the Violet® App is provided over the internet and mobile networks and so the quality and availability of the Violet® App may be affected by the factors outside the reasonable control of Ultra.
Ultra including its group of companies, associates, representatives etc. do not accept any liability or responsibility whatsoever for unavailability of the Violet® App, or any difficulty or inability to download or access content or any other communication system failure which may result in the Violet® App being unavailable and for any support or maintenance for the Violet® App.
In no event Ultra will be liable for any direct, indirect, special, punitive, exemplary or consequential losses or damages of whatsoever kind arising out of your use, download or access to the Violet® App including your commission/omission of any action based on the contents of the Violet® App, including loss of profit or the like including any damage or alteration to your device /equipment including but not limited to computer equipment, handheld device or mobile telephones as a result of the installation or use of the Violet® App.
The Violet® App and software are provided on "as is" and "as available" basis without warranty of any kind.
Ultra may terminate use of the Violet® App at any time. Upon any such termination, (a) the rights of use granted to you herein shall immediately terminate; (b) you must cease from using the Violet® App.
These Mobile app terms are governed by the internal substantive laws of the State of Oregon.
Jurisdiction for any claims arising under this agreement shall lie exclusively with the state or federal courts within Portland, Oregon. If any provisions of these Mobile app terms are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Mobile app terms, which shall remain in full force and effect. No waiver of any term of these Mobile app terms shall be deemed a further or continuing waiver of such term or any other term. In addition, Ultra's failure to enforce any term of these Mobile app terms shall not be deemed as a waiver of such term or otherwise affect Ultra's ability to enforce such term at any point in the future.
